The Complaints Committee was ruling on a complaint from Groupama-2 against Geant and Gitana 11 and an appeal by Geant. The two cases concerned the first leg of the Grand Prix du Port de Fécamp and the way they completed the course. In a nutshell, the race instructions specify that a windward/leeward race may be reduced in two ways: by the sending out of the “S” (Sierra) flag on a boat signifying that the finish is to be judged between the buoy to be rounded and that boat, or by the sending out of the “O” (Oscar) flag indicating that the finish will be judged between two yellow buoys marking the finish line but after having previously passed through the “door” formed by buoys “3” and “3bis” on the course.
De facto, the two crews of Geant and Gitana 11, absorbed by their duel at close quarters, failed to pay attention to the committee boat moored close to mark “2” and flying the “O” flag. Consequently, they completed the course as if it had not been reduced and did not therefore observe the “door”, in contrast to their two pursuers, Groupama-2 and Gitana 12. Loick Peyron and Michel Desjoyeaux have therefore been disqualified for this round, which changes the provisional general ranking based on the day's three rounds: Gitana 11, Groupama-2 and Gitana 12 are now all equal on points.
